Welcome to Cheeky Wags. By creating an account or using our platform, you agree to these Terms of Service. Please read them carefully.

1. About Cheeky Wags

Cheeky Wags (“we”, “our”, “the platform”) is operated by The Baobab Collective and is an online marketplace that connects pet parents with independent pet care service providers (“vendors”) and veterinary professionals in Kenya. We do not employ, endorse, or guarantee any vendor or vet listed on the platform.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts under Kenyan law. By registering, you confirm that the information you provide is accurate and complete.

3. Account Types

Pet Parents

Pet parents can browse vendors, book services, post job requests, manage Pet Passports, and communicate with service providers. Pet parent accounts are free.

Vendors

Vendors can list services, apply to job requests, manage bookings, and build a storefront profile. Vendors may subscribe to our Plus plan (KES 1,500/month) for enhanced features. Vendors are independent contractors, not employees of Cheeky Wags.

Veterinary Professionals

Vets can access the platform to manage patient records, issue Pet Passports, and connect with pet parents. Vet accounts are free and subject to license verification.

4. Platform Role

Cheeky Wags is a marketplace only. We facilitate connections between pet parents and vendors but do not provide pet care services. We are not a party to any agreement between a pet parent and a vendor. We do not guarantee the quality, safety, or legality of any services listed.

5. Payments

All payments for services are made directly between the pet parent and vendor, typically via M-Pesa. Cheeky Wags does not hold, process, or transfer funds on behalf of users. Payment terms (upfront, deposit, or after service) are agreed between the parties before a booking is confirmed.

Vendor subscription payments (Plus plan) are processed through Pesapal and are non-refundable for the current billing period.

6. Vendor Obligations

  • Provide accurate information about your services, pricing, and availability
  • Deliver services as described and agreed upon in each booking
  • Maintain any required licenses, permits, or insurance for your services
  • Respond to booking requests and messages in a timely manner
  • Not engage in fraudulent, misleading, or harmful conduct
  • Not share or use personal information of pet parents outside of the platform

7. Pet Parent Obligations

  • Provide accurate information about your pets, including health conditions and behavioral issues
  • Pay for services as agreed in the booking terms
  • Treat vendors with respect and communicate clearly
  • Not engage in fraudulent, misleading, or harmful conduct

8. Reviews & Content

Users may leave reviews after completed bookings. Reviews must be honest, factual, and based on genuine experiences. We reserve the right to remove reviews that contain hate speech, threats, false information, or violate these terms. Vendors may reply to reviews publicly.

9. Prohibited Conduct

  • Creating fake accounts or impersonating others
  • Posting false, misleading, or defamatory content
  • Harassing, threatening, or abusing other users
  • Attempting to circumvent platform fees or restrictions
  • Scraping, automated access, or reverse engineering of the platform
  • Any activity that is illegal under Kenyan law

10. Account Suspension & Termination

We may suspend or permanently close your account if you violate these terms, engage in prohibited conduct, or if we reasonably believe your use of the platform poses a risk to other users or pets. You may also delete your own account at any time from your account settings.

11. Disputes Between Users

Cheeky Wags is not responsible for disputes between pet parents and vendors. However, we may assist in mediation at our discretion. If a dispute arises, we encourage both parties to communicate directly first. If unresolved, you may contact us at support@cheekywags.com and we will review the matter based on booking records, messages, and payment proof available on the platform.

12. Limitation of Liability

To the maximum extent permitted by Kenyan law, Cheeky Wags shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform, including but not limited to injury to persons or pets, property damage, loss of income, or service failures by vendors.

Our total liability shall not exceed the amount you have paid to Cheeky Wags (not to vendors) in the 12 months preceding the claim.

13. Intellectual Property

All content, design, logos, and software on the Cheeky Wags platform are owned by The Baobab Collective. Users retain ownership of content they upload (photos, reviews, messages) but grant us a non-exclusive license to display it on the platform.

14. Data Protection

We process personal data in accordance with Kenya’s Data Protection Act (2019) and are registered with the Office of the Data Protection Commissioner (ODPC). For full details on how we collect, use, and protect your data, please read our Privacy Policy.

15. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or a notice on the platform. Continued use of the platform after changes constitutes acceptance of the updated terms.

16. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
